Department of Defense takes a Broad and Expansive view on Registerable Offenses

On November 21, 2024, the Department of Defense published a new instruction 1325.06 (DoDI 1325.07) as to matters concerning the Administration of Military Correctional Facilities, Clemency and Parole Programs.  This new instruction includes recent changes impacting sex offender registration for offenses on and after 1 January 20219 that will require registration.  Most notably, Article 117a of the Uniform Code of Military Justice, which prohibits the Wrongful Broadcast or Distribution of Intimate Visual Images, is now an offense that, upon conviction, qualifies as a registerable offense requiring sex offender registry.  UCMJ Article 117a, and other registerable offenses may be examined in Tables 1-4 of the DoDI 1325.07.

This development is significant and may have a far-reaching impact. The increased prosecution of broadcasting and distribution offenses under UCMJ Article 117a mirrors the proliferation of electronic communications and messaging as part of 21st-century courtship among young servicemembers.
